Article 1 (Application)
These Terms of Service ("Terms") govern the use of the rental car reservation system ("Service") provided by Yoshimura Rental Car ("Company").
1. These Terms apply to all relationships between the Company and registered users regarding the use of the Service.
2. Any rules posted on the Company's website regarding the use of the Service form part of these Terms.
3. In case of any discrepancy between these Terms and other explanations of the Service, these Terms shall take precedence.
Article 2 (Definitions)
The following terms used in these Terms have the meanings set forth below:
"Service Use Agreement" means the agreement between the Company and a registered user for the use of the Service under these Terms.
"Intellectual Property Rights" means copyrights, patents, utility model rights, design rights, trademark rights, and other intellectual property rights.
"Posted Data" means any content posted or transmitted by registered users through the Service.
"Company" means Yoshimura Rental Car.
"Company Website" means the website operated by the Company with the domain "https://yoshimurarentalcar.com".
"Registered User" means an individual or corporation registered as a user of the Service under these Terms.
"Service" means the service accessible through the Company's account.
Article 3 (Registration)
1. A person wishing to use the Service ("Registration Applicant") may apply for registration by agreeing to these Terms and providing required information to the Company.
2. The Company shall determine whether to approve the registration application based on its criteria.
3. A service use agreement shall be formed between the registered user and the Company upon completion of registration.
4. The Company may refuse registration if the registration applicant falls under any of the following:
False, incorrect, or incomplete registration information
Minor, adult ward, person under curatorship, or person under assistance without proper consent
Anti-social forces or related parties
Previous violation of agreements with the Company
Previous measures under Article 10
Other cases deemed inappropriate by the Company
Article 4 (Changes to Registration Information)
Registered users shall promptly notify the Company of any changes to their registration information.
Article 5 (Password and User ID Management)
1. Registered users shall properly manage and store their passwords and user IDs.
2. Registered users shall be responsible for any damages caused by inadequate management of passwords or user IDs.
Article 6 (Fees and Payment Methods)
1. Registered users shall pay the usage fees displayed on the Service to the Company through the payment method specified by the Company.
Article 7 (Prohibited Matters)
Registered users shall not engage in any of the following acts:
Acts that violate laws or are related to criminal activities
Fraud or threats against the Company or other users
Acts against public order and morals
Infringement of intellectual property rights or other rights
Transmission of harmful or inappropriate information
Acts that place excessive load on the Service's network or system
Reverse engineering or analysis of the Company's systems
Acts that may interfere with the operation of the Service
Unauthorized access to the Company's network or systems
Impersonation of others
Use of other users' IDs or passwords
Unauthorized advertising or solicitation
Collection of other users' information
Acts causing disadvantage, damage, or discomfort to others
Acts violating the Service usage rules
Providing benefits to anti-social forces
Acts for the purpose of meeting unknown members of the opposite sex
Other acts deemed inappropriate by the Company
Article 8 (Suspension of Service)
The Company may suspend or interrupt the Service without prior notice in the following cases:
Emergency maintenance of computer systems
System failures or excessive access
Force majeure events
Other cases deemed necessary by the Company
Article 9 (Intellectual Property Rights)
1. All intellectual property rights related to the Service belong to the Company.
2. Registered users warrant that they have lawful rights to post or transmit content.
3. Registered users grant the Company a worldwide, non-exclusive, royalty-free license to use their posted content.
4. Registered users agree not to exercise moral rights against the Company.
Article 10 (Account Deletion)
The Company may delete or suspend accounts in the following cases:
Violation of these Terms
False registration information
Payment issues or bankruptcy
No Service usage for 6 months or more
No response to Company inquiries for 30 days or more
Cases falling under Article 3, Paragraph 4
Other cases deemed inappropriate by the Company
Article 11 (Service Period and Withdrawal)
1. The service period shall be the period selected by the registered user.
2. Registered users may withdraw from the Service by completing the prescribed withdrawal procedure.
Article 12 (Changes to Service)
1. The Company may change or terminate the Service at its discretion.
2. The Company shall notify registered users in advance when terminating the Service.
Article 13 (Disclaimer)
1. The Company makes no warranties regarding the Service.
2. The Company's liability for damages shall be limited to 5000 yen, except in cases of willful misconduct or gross negligence.
3. Registered users shall resolve any disputes with other users or third parties at their own responsibility.
Article 14 (Confidentiality)
Registered users shall maintain the confidentiality of non-public information disclosed by the Company.
Article 15 (Handling of User Information)
1. The Company shall handle user information in accordance with its Privacy Policy.
2. The Company may use and disclose statistical information that cannot identify individuals.
Article 16 (Changes to Terms)
1. The Company may change these Terms when necessary.
2. Changes shall be notified through the Company's website or other appropriate means.
3. User consent shall be obtained when required by law.
Article 17 (Contact/Notification)
1. Communications between the Company and registered users shall be made through the Company's prescribed methods.
2. Notifications sent to registered email addresses shall be deemed received.
Article 18 (Assignment of Rights)
1. Registered users may not assign their rights or obligations without the Company's written consent.
2. The Company may assign its business, including user information, to third parties.
Article 19 (Severability)
If any provision of these Terms is invalid, the remaining provisions shall remain in full force and effect.
Article 20 (Governing Law and Jurisdiction)
1. These Terms shall be governed by Japanese law.
2. Any disputes shall be subject to the exclusive jurisdiction of the summary court having jurisdiction over the Company's headquarters.
